There is no obligation to accept funds once the tenant is in default. In fact, I usually turn off the tenant's ability to pay on our portal system and refuse to accept funds once we file for eviction.
Hey all, I have court on Monday and the tenant plans to pay. I am so done with the run around, I don't want to accept the funds. I am looking for written opinion on declining the funds. And do I have to modify my case to possession only?
